Providing consumer credit is governed by laws and regulations.
In principle, providing loans to consumers requires a licence from the Netherlands Authority for the Financial Markets (AFM) under the Financial Supervision Act (Wet op het financieel toezicht). Rules of conduct also apply to the provision of credit. These conduct of business rules include the provision of adequate information, obtaining information to prevent excessive lending and advertising rules.
A licence from the AFM is also required if intermediary or advisory services in relation to credit are provided. Intermediary services aimed at the conclusion of a credit agreement qualifies as intermediary services, but also the management and of credit agreements falls within the scope of credit intermediary services.
